The customer accepts the following conditions of this contract through the payment of services and products by Tabacchi Isabella, named as Isabellandscapes by Isabella Tabacchi with any payment method, including Teachable Payments.
Purpose of these terms and conditions
These general terms and conditions govern the contractual relationship between Isabellandscapes Photography by Isabella Tabacchi and the people (customers) who purchase goods (Video Course on TK8 luminosity masks, Your Pic tutorial, coaching, on this site or through it.
The terms and conditions apply in their current version at the time of the conclusion of the contract. Depending on the customer's device, this document can be printed and / or saved.
Isabellandscapes Photography by Isabella Tabacchi may modify these terms and conditions at any time, without providing explanations and without notice.
Offer and conclusion of the contract
The prices of the Isabellandscapes Photography by Isabella Tabacchi online store represent an offer in compliance with Italian law.
After entering the customer's details and clicking on the order button, the customer enters into a binding sales contract with Isabellandscapes Photography by Isabella Tabacchi and accepts the terms and conditions.
Price, deadline, payment
The prices in EURO indicated in the online shop are valid prices. The prices indicated are inclusive of Italian VAT, in some cases a commission percentage required by the chosen payment method (Paypal, Teachable payments) will be applied.

PayPal
During the ordering process you will be redirected to the PayPal site. A small fee required by Paypal will be applied.
Wire transfer
(Not present on Teachable) After a purchase agreement between the seller and the buyer via email, the buyer will receive data such as the IBAN number and the BIC / SWIFT for the bank transfer. REIMBURSEMENT
Even though Teachable Payments issues the refund within 30 days, Isabellandscapes Photography does not accept refunds for ANY REASON. Given the conflict between the two reimbursement conditions between Tabacchi Isabella and Teachable, any refunds issued by Teachable or after any Chargebacks won, also requested externally through your credit institution or credit card or Paypal, must be reimbursed by the customer to Tabacchi Isabella in addition to the legal fees made by Tabacchi Isabella to recover the credit from the customer who won the refund.
Refund requests will not be accepted even if the customer claims to have carried out the transaction without her consent, as a result of any reason such as theft of his credit card, identity, cloning etc.
When the customer wins any appeal or chargeback, Tabacchi Isabella takes immediate legal action. The customer will receive a warning requesting the reimbursement of the amount won plus any fees charged to Tabacchi Isabella for the chargeback plus the legal fees incurred by Tabacchi Isabella no later than 7 days from the date of sending the registered letter by Tabacchi Isabella.
If the address of residence / domicile, identity or email provided by the customer on the Teachable platform, or on any other platforms that Tabacchi Isabella uses for the sale, are not correct, or only one of these is correct, criminal penalties will be applied due to the fact that the customer did not undertake to provide correct data at the time of purchase.
In case of non-payment of the amount required by the reminder notice within 7 days from the date of sending the notice by Tabacchi Isabella, further reimbursement penalties will be applied for the additional legal costs due to the recovery of the credit by Tabacchi Isabella. , towards the customer.
This credit recovery procedure will take place according to Italian law through the lawyer of Tabacchi Isabella.
Delivery
Orders are generally available for the customer to download immediately after payment or are produced on the working days defined by Isabellandscapes and then shipped. However, Isabellandscapes Photography by Isabella Tabacchi reserves the right to deliver (and therefore download) the ordered products at a later time for various reasons (in particular technical malfunctions of various kinds). Contact us immediately if the download does not work or in case of errors of various kinds, so that the problem can be resolved as soon as possible.
Isabellandscapes Photography by Isabella Tabacchi has the right to modify, interrupt or temporarily or permanently suspend the download option at any time.
There is no entitlement to further downloads after the first full download (re-download).

Copyright in downloads

Conditions of sale of online lessons, digital products and prints
Isabellandscapes Photography by Isabella Tabacchi assumes no responsibility for reimbursement if the buyer is not satisfied with the product or service after payment or if the product is not as the customer expected.

- Prezzo, scadenza, pagamento
I prezzi in EURO indicati nello shop online sono da intendersi prezzi validi. I prezzi indicati sono comprensivi di iva italiana, in alcuni casi verrà applicata una percentuale di commissione richiesta dal metodo di pagamento prescelto (Paypal, Teachable payments).
Sono possibili variazioni di prezzo. Il prezzo dichiarato al momento dell’accettazione è determinante.
Il prezzo è dovuto alla conclusione del contratto di acquisto e avviene nell’immediato. Una volta che la transazione è andata a buon fine, il cliente potrà scaricare gli articoli che desidera oppure gli verranno immediatamente spediti tramite mail o siti come WeTransfer, TransferXL e altri. Oppure, nel caso del video corso, i contenuti possono essere visualizzati online.
Isabellandscapes Photography di Isabella Tabacchi si riserva il diritto di modificare i prezzi in qualsiasi momento senza fornire spiegazioni.
Isabellandscapes Photography, inoltre, si riserva di ritirare il prodotto al cliente, disiscrivendo il cliente dal corso in caso di sospetti su attività illecite, come l'accesso da più di due dispositivi differenti (diversi indirizzi IP registrati sulla piattaforma) o il fatto di fornire informazioni fasulle per chiedere sconti, rimborsi o fare finta di non apprezzare il prodotto per ricevere rimborsi non meritati, o altre attività che lei personalmente ritiene sospette.

PayPal

Bonifico bancario
(Non presente su Teachable) Dopo un accordo di acquisto tra il venditore e l’acquirente via email, l’acquirente riceverà dati come il numero IBAN e il BIC / SWIFT per il bonifico bancario. Il prodotto verrà inviato o erogato solamente al momento della ricezione del denaro sul conto bancario di Tabacchi Isabella.
RIMBORSO
Anche se Teachable Payments rilascia il rimborso entro 30 giorni, Isabellandscapes Photography non accetta rimborsi per NESSUN MOTIVO. Dato il conflitto tra le due condizioni di rimborso tra Tabacchi Isabella e Teachable, eventuali rimborsi rilasciati da Teachable oppure dopo eventuali Chargeback vinti, richiesti anche esternamente tramite il proprio istituto di credito o carta di credito o Paypal, dovranno essere risarciti da parte del cliente a Tabacchi Isabella in aggiunta alle spese legali effettuate da Tabacchi Isabella per recuperare il credito dal cliente che ha vinto il rimborso.
Non saranno ammesse richieste di rimborso anche nel caso il cliente affermi di aver effettuato la transazione senza il suo consenso, a seguito di qualsiasi ragione come per esempio furto della sua carta di credito, identità, clonazione etc.
Quando il cliente vince un eventuale ricorso o chargeback, Tabacchi Isabella intraprende azioni legali immediate. Il cliente riceverà una diffida che sollecita il rimborso della cifra vinta più le eventuali commissioni addebitate a Tabacchi Isabella per il chargeback più le spese legali effettuate da Tabacchi Isabella entro e non oltre 7 giorni dalla data di invio della raccomandata da parte di Tabacchi Isabella.
Se l'indirizzo di residenza/domicilio, identità o mail fornito dal cliente sulla piattaforma Teachable, o su eventuali altre piattaforme che Tabacchi Isabella usa per la vendita, non sono corretti, o lo è solamente uno di questi si applicheranno sanzioni penali dovute al fatto che il cliente non si è impegnato a fornire dati corretti al momento dell'acquisto.
In caso di mancato pagamento dell'importo richiesto dalla diffida di sollecito entro i 7 giorni dalla data di invio della diffida da parte di Tabacchi Isabella, si applicheranno ulteriori sanzioni di rimborso per le ulteriori spese legali dovute al recupero del credito da parte di Tabacchi Isabella, nei confronti del cliente.
Questo procedimento di recupero credito avverrà secondo la legge Italiana tramite il legale di Tabacchi Isabella.
- Consegna
Gli ordini sono generalmente disponibili per il cliente per il download subito dopo il pagamento o vengono prodotti nei giorni lavorativi definiti da Isabellandscapes e quindi spediti. Tuttavia, Isabellandscapes Photography by Isabella Tabacchi si riserva il diritto di consegnare (e quindi scaricare) i prodotti ordinati in un secondo momento per vari motivi (in particolare malfunzionamenti tecnici di varia natura). I download sono protetti da copyright. Il cliente riceve il diritto semplice, non esclusivo, non trasferibile e non cedibile in sublicenza di utilizzare i documenti offerti per uso esclusivamente personale in conformità con la legge sul diritto d’autore secondo le modalità offerte.
I download offerti sono una creazione intellettuale di Isabellandscapes Photography di Isabella Tabacchi e hanno un carattere individuale. Sono quindi protetti dalla legge italiana sul diritto d’autore di cui all’art. 13.
Il cliente può scaricare i download una volta. Queste immagini sono destinate all’uso privato. Tuttavia, al cliente è espressamente concesso il diritto di utilizzare il materiale dell’immagine senza restrizioni e per intero in privato. È inoltre consentito pubblicare le immagini sui social network come X-ing o LinkedIn e utilizzarle per dossier applicativi.
Se il cliente desidera utilizzare un’immagine a scopo commerciale (ad esempio su un sito Web aziendale o per una campagna pubblicitaria), deve informare preventivamente Isabellandscapes Photography di Isabella Tabacchi. - Esclusione di responsabilità
Il contenuto dei prodotti da scaricare è stato creato con grande cura e impegno.
Con l’acquisto il cliente accetta il contratto.
- Condizioni di vendita di lezioni online, prodotti digitali e stampe
Isabellandscapes Photography by Isabella Tabacchi non si assume alcuna responsabilità di rimborso se l’acquirente non è soddisfatto del prodotto o del servizio dopo il pagamento o se il prodotto non è come il cliente si aspettava.
Soprattutto per quanto riguarda il risultato del video tutorial di Your Pic o delle lezioni Skype, dipende dalla qualità del RAW originale che viene consegnato dall’acquirente a Isabellandscapes Photography di Isabella Tabacchi. Isabella Tabacchi farà del suo meglio per tirare fuori il meglio dalla foto consegnata ma non è garantito che l’immagine finale sarà impressionante come i suoi lavori o come il cliente si aspettava, soprattutto se la qualità del RAW originale non è eccelsa secondo la sua opinione. Un RAW corretto ha tutte le informazioni che possono essere utilizzate e modellate per migliorare l’immagine (o le esposizioni in caso di esposizione multipla, messa a fuoco o panorama) ma questo non significa che l’editing dell’immagine è il solo ingrediente da considerare nella creazione dell’immagine finale. La post-produzione fa parte del processo, possiamo davvero migliorare le immagini, ma uno scatto che non è tecnicamente buono all’inizio non sarà mai paragonabile a un’immagine che ha la migliore luce e composizione sin dalla sua creazione durante la fase di scatto.
